Legal Question in Real Estate Law in Texas
I live in Texas and my husband sold a house "by owner." We made a "contract" for 30 yrs. with fees and stipulations. He and the buyer signed it and my sister notarized it. It has never been filed anywhere and now the buyer is always late on payments. There were stipulations for that but he always seems to make payments when he wants and has never paid any late fees (even though he owes them) that we stipulated in the contract.
At this point I want him out. What are our options if any? If we have no options to get him out, can we at least get him to pay the way he is supposed too?

Of course. I would first attempt an eviction. The forms and instructions will be at the local justice of the peace office. If that doesn't work, you may need an attorney.
