Legal Question in Real Estate Law in Texas
A loss in civil courts ability to garnish my wages
Im involved in a Civil Lawsuit in the state of Florida. It is over some trees that were cut from my land and from my neighbors. I now live in Texas and own a home there, I have no ties to Florida what so ever. My question is, if I lose this lawsuit or just drop my defense and allow a judgment against me to happen what could be the consequences? Could my wages be garnished? Could my bank account be debited? Could they attach a lien to my house? If the answer to any of these questions is yes what is the chance of this happening to me. Can a judge in Florida enforce any of these things in Texas? I have already offered to settle with the neighbor for 4000.00 when the trees werent worth more than 1000.00 but it seems like he and his Lawyer see big bucks down the road because Im working in Iraq. Please if you can help I would really appreciate it, my lawyer just wants to keep going but I cant blame him hes getting paid as well.

Get the lawsuit dismissed if you can, then you won't have to worry about it. A default judgment is difficault to enforce and most fall to the wayside. So the reality of it is that they probably won't come after you, but they could.
