Legal Question in Real Estate Law in Texas
Lying real estate agent
I purchased 12 acres in Southeast Texas that had a diverse plant community existing within it. At closing, at the title company, I asked the real estate agent and the title company associate atleast six times if anyone would be able to come onto the property to drill, trench, dig, or in any way extract materials from my property before I signed the closing papers. They both assured me everytime I asked the same question that no one had the right to come onto my property for minerals or anything.
Now Anadarco Petroleum is proposing to drill right off the corner of property and the proposed drill site would overlap my property, with storage tanks being on my property.
I was under the impression that title companies had to tell you the truth about these things.
Do I have any legal recourse with the title company or real estate agency since they flat out lied to me repeatedly? Is there anything I can do to stop the drilling and subsequent destruction of my quality of life on this property?

To partially answer your question, it sounds like you're saying that Anadarco Petroleum is asking whether they can drill. If this is the case, then you can just tell them, "no."
If instead it turns out that there was an existing lease on the property, or the minerals were retained by the seller, then I will leave this question to be answered by an attorney who is more knowledgeable in litigation matters.
