mineral rights

We sold our home and negotiated and retained our mineral rights. In return we left a Kabota tractor and a custome shuffleboard table. His realtor failed to put the mineral rights in the last legal document to the title company. We had leased the surface rights 3 yrs. previous. We knew the oil drilling was coming. We would NEVER have sold our mineral rights with the house. Do we have any recourse?

It depends. Does the contract or any other document mention a mineral reservation? You might maintain a suit to reform the deed, but it won't be cheap. Is there a chance the buyer will simply agree to do the right thing and correct the deed? And why were you relying on a realtor of all people to get the legal documents straight?
