Legal Question in Real Estate Law in Texas

What to do about mobile home purchase deal

Made a deal with a mobile home dealer/lot Owner to buy two used homes, one for me & one for my Daughter. We wanted new homes, but he could not help. This was not true we found out. As main part of the Contract, lists of needed repairs were turned in. Although the Owners' repairmen have been out several times, most of the work has not been done, and what work has been done has been sub-par. As well, there has never been a closing on my home or agreement signed for my Lot. We have been paying the Mortgage and Lot payments for our homes since September, 2007. The Owner has been spoken with repeatedly about repairs being done unacceptably. He offers to do less each time, thereby voiding our verbal Original Contract with him. Also, Escrow Funds are being used indescriminately by his Wife, who works for him. I think all monies paid on my home should have been Escrowed. He has broken any contracts between us and want either; be placed in new homes as we went to him about, have all repairs done/re-done and closing on my home, or all monies paid to him refunded. I have more details.

I am disabled and my Wife needs Surgery that Insurance will not cover. We can make payments, or save up for needed help. Is there anyone that can help us.

If the amount being held is under $10,000, you can sue in small claims court to recover it. Be sure and ask for reimbursement for court costs and your expenses.
