Legal Question in Real Estate Law in Texas

Money owed for carpet depreciation?

After I moved from my apartment, they sent a letter that not only were they keeping my deposit, but they also wanted to charge me about $140 to pay for carpet depreciation. The manager said they don't charge everyone for this. She said they had photos of the carpet and this would explain why I was being charged. I said I wanted to see them and she said she would look for them. The next time it was that they were being developed. Now they say they don't have photos and they will cut the charges in half. If I don't pay they will turn me in to a collection agency. Shouldn't they have proof in order to charge me for the condition of the carpet? Is there a law that clearly addresses this?

No. It is your word against theirs. They can prove it up with witnesses, etc. It will be the judge's decision.
