Legal Question in Real Estate Law in Texas
The mortage lone on my home is in my ex-husbans name, but I want to start making the mortage payments. He wants his name off the mortage loan and wants me to get the loan in my name. He refuses to let me make payments while the loan is still in his name. Will the mortage company accept my payment, even though his name is on the mortgage loan?

As a practical matter, the banks don't really monitor where the money comes from on a loan payment. As for getting the loan in your name, the only real way to do this is for him to sell you the house (or for you to refinance.) Depending on the equity in the home, this can be a very simple process.
