Can the mortgage company foreclose your house if you have a signed contract?

A signed contract for what? How are they doing the foreclosure? Judicially or nonjudicially? I'm going to make the following assumptions in an attempt to answer your question: You have a nonjudicial foreclosure, in which notice has been sent and it's set to foreclose in the near future. In the meantime, you found a person to purchase it. If that's the case, then yes, they can proceed and you would be out of luck. However, most companies don't really want to foreclose and will work with you, especially if you have a person interested in buying the property. You need to communicate with the foreclosing attorney ASAP. You should use a real estate attorney to stall the foreclosure, so that the foreclosing company knows that you are for real.
