Legal Question in Real Estate Law in Texas

mortgage company/insurance check

House total loss, Hurricane. Owe 77000 mortgage. Insurance pay 30000. Mortgage will not apply funds to my back or future payments. Had me send in this, send in that for 5 months untill they finally tell me i have to pay back payments with my personal checking. They are constantly harrasing me for the payments. Credit is ruined. Told me they cannot apply 30000 to future payments because what if ten years down the line i will not continue to pay. Is that legal to say? How dare they ruin my excellent credit assuming i will not continue payments? Where, how do i file suit on this unreal nightmare i am going thru? Thank you.
