Legal Question in Real Estate Law in Texas

My neighbor has three 8ft+ poison ivy plants growing between his garage and my fence line. They have grown through the fence in places and grow over the fence. He leases the property so does not live there and repeated calls and texts to have something done about it have gotten no real response. I have a 5 month old son and am worried that once he gets mobile he will get into the poison ivy. What are his responsibilities to remove the poison ivy? Can I hire someone to remove it from his property and send him the bill? If my baby gets poison ivy can I send him the doctor bill for that since I have repeatedly asked him to remove the plants?

Start by reporting this problem to the city. You'll probably get transferred six or eight times before you get the right person on the line.

If that doesn't work, you can sue him for having a nuisance on his property, and ask for an order that requires him to remove it.

Do not hire someone to go onto his property and remove anything.
