Legal Question in Real Estate Law in Texas

neighbor law/property line dispute

My grandfather has lived on this land for 45+ years his neighbor passed away and his daughter sold his land. When she did their survey showed that a fence that has been there for the entire time my grandfather has lived there was 5-10 feet on their land. Our survey does not seem to match this. Is the squatter rights hold up since the fence has been there for so long?

Re: neighbor law/property line dispute

Whether or not your Grandfather acquired the property by adverse possession can be complicated, and you must first find out if he paid the taxes on the disputed land. That will depend upon an accurate survey, and from your post I would suggest you get a current survey to at least establish the property line without dispute.

If you are sure the fence was not reasonably close to the property line, then check with a real estate lawyer in your area for futher options.
