my neighbors tree broke and landed on my truck and it has been there all day . he has seen it and has not removed it... what do i do?

First: Take pictures. Lots of pictures.
Then go talk to your neighbor and ask him what he plans to do. Bring two cans of cold beer. When he answers the door, the first thing you should say is, "I hope you like Miller Lite."

It is possible that neighbor's homeowner's insurance may pay for the removal and damage to your vehicle. If neighbor doesn't acknowledge your existence, then take pictures, have tree removed at your expense, then ask for reimbursement in writing. If he fails to reimburse, then you can sue for reimbursement in small claims court, assuming your claim is under $10,000.
