Legal Question in Real Estate Law in Texas
oral agreement with seller
My grandfather has just recently purchased a home located on a river. Before he purchased the home the seller agreed to fix the ceiling tiles that where torn up,to replace the refrigerator that she had taken out. After he bought the house he found out the septic system had a leak and that the river authority had already stepped in. When asked about it the seller assured him she would pay to have it fixed. (this was all stated in front of several people) Now she refuses to do any of the repairs. Since it is too late for him to get out of this purchase can he make her stand up to the agreement. Any information would be greatly appreciated.

Re: oral agreement with seller
It is a matter of proof. If you can prove it, you may be able to litigate it. It also depends on the language of the sales contract, as some sales contracts have language in them that states that the contract supercedes all oral negotiation. There may be ways around that, but it would be fact specific.
I suggest you get local counsel on the matter immediately.
