Legal Question in Real Estate Law in Texas
original mortgage papers
I obtained a home equity loan several years ago, and as I was cleaning out an old filing cabinet I came across my original mortgage papers and they are stamped paid with a letter from the mortgage stating that my mortgage was paid in full. Shouldn't the home equity mortgage company have these and not me?

Re: original mortgage papers
No. The papers are yours. The home equity company got a title policy that provides satisfaction that your old loan is paid in full.
