Legal Question in Real Estate Law in Texas
Who really owns the house
My 86 year old mother was convinced by her daughter to repair a small cottage on the daughter's property. She could then live in the cottage and had her file for homestead exemption on the house only. Who really owns the cottage? Is this considered an asset for the mother?

Re: Who really owns the house
The deed to the property controls ownership in the absence of forgery or fraud.
Whoever's name is on the deed owns the real estate and the immovable structures on it.
To protect the Mother the property should be deeded to her in her name.
