Legal Question in Real Estate Law in Texas

Our parents died in 2007 & 2008 without a will. There are 3 living siblings and no other close relatives left. They owned their home and we have continued to maintain the home. My two brothers have agreed to turn the home over to me and my husband without receiving any remuneration. What is the process for having this done.

If there are no other debts, then you can use summary procedures to clear title to the home. Most likely, you would need heirship affidavits (if there is no other property besides the home_ or small estate affidavits (if there are other pieces of personal property, such as bank accounts) to clear title, then deeds to transfer interests. We do these in my office all the time. It takes about a week for the former and about a month for the latter.
