Partnership in Real Estate

we are 50% in R/E with brother in law. We want him to promise to pay our 2 sons our 50% if something should happen to both my husband and I. Can we just put that in writing and have my Brother in Law sign that he promises to do this?

The safer way to do this is with a survivorship deed. Make sure it meet the statutory requirements.

Amend the the existing partnership with new and to add this clause. Consult the lawyer
