Legal Question in Real Estate Law in Texas

My parents live in a house on a hill and have lived there for over 33 years. The church in back of them has expanded several times since then and has added a parking lot that goes down well past my parents house. The church did not drain the addition and the parking lot and is just letting nature take its course. My parents have had foundation problems since then with the water eroding the soil around and under their house and water actually entering the house. They have had the foundation repaired once and an engeneer came out this week and said the damage they have now is estamated at over $8,000 dollars. They feel as I do that the church is responsible for these damages because they did not install proper drainage for the new addition as well as the parking lot. My parents are both retired and can not afford to keep this up. Do you think they have a claim?
