Petition agrement
Iam buying a home with money that was mine before i met my husband in texas i was told to use a petition agrement, that form will sign all legal rights away from him,i have to make sure he cant come after my kids and i after we divorse, will this protect us?What is the cost?If not the right form what is? When you take title to your property next week, have the title company put your name on the deed as "Mary Doe, a married woman, as her sole and separate property." Then, after that, as icing on the cake, you can have your new husband sign a disclaimer deed to you which will disclaim any interest he has in the property. Have the title company record the disclaimer deed after the deed into you. Keep in mind, that if the marriage goes south, he could ask for reimbursement of any payments, improvements, taxes, etc. that are paid in the future from his separate or community funds, as could you, if the shoe were on the other foot.
