Legal Question in Real Estate Law in Texas

Problem with family members.....read on....

I will try to make short since we have few characters. Email for more information. My husband & I put money down on a house, paid closing costs, all mortgage insurance HOA dues, repairs & have handled everything as our home for nearly 3 years. The home caught fire & burnt down Jan 09. We have handled claim filing, hiring of restoration company & construction co. My sisterinlaw is on the title. She told us a month ago, ''thanks for my investment property'' it is no longer yours. You can not move back in & I am not paying you the money for the lost property. She also will not give us any of our money back from the downpayment or closing costs. I think we have squatters rights on our side, as well as Despicable act in TX?? I really need to know what to do. Send a demand letter to start? We are lost on our next option but I cant very well sit back and let this happen. All of our items that were not destroyed are being held for payment. I have proof of her & husband calling this ''our home'' & all payments of everything we have ever paid, under the impression this house would be deeded to us at some point. There is a lot more to this story please email me.....

Is there a written agreement between you and sister in law? If not, why not?

Did you make the mortgage payments?
