Legal Question in Real Estate Law in Texas
property boundries
We purchased 100+ acres, fenced. We had the back clear cut. After that the person who lives behind us took down the border fence and replaced it, moving it to the correct fence line. He is now saying we had his property clear cut. We had snares put on the fence which he took down saying the fence is his. The question is who does the fence belong to? Does he have a right to remove things attached to it if it is actually on our side and does he have any legal litigation that he could persue in regards to us clearcutting the fenced property?

Re: property boundries
One would need more facts to detmine liability. If the previous fence had been in place for over 10 years, the owner who was encroaching on other person's property, may have adversely possessed that property. If a substantial amount of land is involved, it may be worthwhile to perfect interest in a quiet title suit. To specifically answer your question, I would need more details.
