Legal Question in Real Estate Law in Texas

Property Damage

Our son swam in a neighbors pool last summer with a friend. The boys put weights in bottom of pool to lift out of water. The other boy lifted a 45lb weight, and ended up dropping it, which caused damage to the pool liner. The owner told the boys not to worry about it. The owner has now contacted us requesting we pay for a new liner. ($1700) Are we responsible for any of it since the other boy caused the damage to the liner? We feel our son is only responsible for putting the weight in the pool...nothing he did damaged the pool liner. The other boy says he will not pay anything. What is the law regarding this? We are not sure if owner will try to do a small claims suit against us. Help!!

Re: Property Damage

You would be liable for you son's actions but this will come down to whether a small claims judge would want to hold your son at least partially responsible for the damage because he put the weights in the pool. You can either stonewall the neighbor or try to settle their claim if they file against you.
