Legal Question in Real Estate Law in Texas

I own property that I inherited from my father. It is wooded and we use it strictly for hunting. The adjoining landowner decided to build a new fence. He never contacted me at all but instead hired a dozer and cleared a 50 ft. pathway onto my property. This was for approximately 3000 yards. He cleared approximately 5 acres of my woods. He proceeded to remove the timber and pile it on his property. Without any topsoil left, erosion problems began. The erosion contractor I consulted gave me a bid of approxiamtely $25,000.00 just to fix the erosion. This does not include anything for the actual trees or any damages of any kind. He fully aknowledges that he did this, so liability is not the issue. If I sued, what kind of award could I expect. I never wanted my property cleared. If I had I would of had it done myself.

Start taking pictures NOW - get a good camera. And write up a narrative - dates, times, witnesses (and contact information for them such as addresses and phone numbers), details, weather (you'll forget this stuff later on if you don't).

And then write a nice letter to your neighbor and explain to him exactly how much damage he's caused (give him a spreadsheet that has a number of dollars down at the bottom). Ask him if he can take care of the repairs/damages. Tell him you'd like to hear from him in the next ten days.

And then make an appointment with a lawyer.
