Legal Question in Real Estate Law in Texas

Property Owner Rights

I own a block with waterfront rights and a pier, many years ago my family allowed my uncle to place a pier on the property line for his own use. He owns no waterfront property. The problem comes from the land in one county and the water another, therefore the pier and land are in different jurisdictions. My uncle sold his pier and owns no waterfront land. The new owner is a jerk and has added on, pouring concrete, operating a business, etc... on my land! It is my understanding that my uncle cannot sell this permission to occupy this area. What are my rights? Can I get rid of this guy?

Re: Property Owner Rights

It depends on what your family actually gave to your uncle and how it was documented. You should hire someone such as an attorney or title company to research what is there. Next, check local zoning to see if his operation of a business is compliant. You may also have a cause of action against him for operating a nuisance. You should hire counsel sooner rather than later, as there are a myriad of other issues to discuss.
