My stepfather passed away eight years ago. From a previous marriage my father has three other children. Is my mother the sole owner of the property that he owned or is the property divided between the four of them? Do the children have any legal right to kick my mother out of the house and move in one of their family members.

When your stepfather died, his kids from a prior marriage inherited his half of the community interest in the house. Your mother still owns her half, plus a life estate in the property as long as it is her homestead. His kids can't kick her out, but she will need to make sure the mortgage, taxes, and insurance remain in place. She may be entitled to a right of reimbursement for some expenses from his kids at the time the property is sold. The best for all involved is to agree upon the terms of settlement and avoid litigation which could cost thousands of dollars.
