Property Water Damage

My neighbor who lives above my unit had a main water line bust while he was not home. All the water came down through the ceiling, light fixtures, and the place looked like Niagra Falls. It was horrible. These are privately owned condominiums I had tenants living at the bottom of the unit where the line busted, when this occured. She said it's not her fault and that her insurance will not pay for damages. We both have property insurance. I called her insurance and they also said the are not liable. But who is liable? Do I have to pay out of my pocket? What can I do?

It may or may not be your neighbor's fault depending on the source of the leak. Contact the homeowner's association to make a determination of fault. Responsibility either lies upstairs or with the HOA - and NOT with you.
