Protection from a predatory real estate agent?
My girlfriend is in the middle of selling her house, and her real estate agent has continually misrepresented the offer. She has continually provided overly pessimistic outlooks (to bully and threaten my girlfriend), and she continually placed pro-buyer amendments into the contract (mind you my girlfriend is the seller) telling my girlfriend it boiler plate and immaterial. In addition, she rushed her through the signing saying that she needed to sign the papers in a matter of hours. Now at close, all of these ''boiler plate'' references are starting to mount as additional costs. Is there legal recourse to either a) nullify the contract before close or b) seek damages from her real estate agent for misrepresentation?

I am not licensed in Texas, but I would imagine that Texas specifies the real estate agent has a fiduciary duty to your girlfriend as we do in Illinois. She should contact a Texas real estate attorney as soon as possible.

Do you have an attorney to review the contract? Are you still in the 5-days attorney modification period of the contract? How many days before closing is it, and what are the "boiler plate" references thast your girlfriend does not like? This answer does not constitute legal advice because you are not as yet my client.
