Legal Question in Real Estate Law in Texas

We are trying to purchase a home here in Texas. We have had a signed contract for over 30 days, and the seller of the home we are trying to purchase from has had our $5000.00 down since April 9, 2010.

The seller due to poor credit, and short time period job is unable to get his new home (2 tries), so he is now backing out of the deal. Due to the real estate agent and the seller I have had my wife come down from MO 4 times to sign the closing (which cost us money that we didn't have to throw away). We now because of these 2 people (the agent and the seller) have because of their stalling have missed out on the federal tax credit for the sale. We also had a chance of buying a home which would have met the deadline for the tax credit, but were told that this was a sure thing. Is there anything we can d?.

The answer to your question lies in the wording of your "signed contract." You need to show it to a lawyer.

You may have the right to sue for SPECIFIC PERFORMANCE - to force him to sell you the house.
