Legal Question in Real Estate Law in Texas
We purchased our 10 acres in 1995. On one side of our property was acreage that was being used as a hay field. There was a old, poorly maintained barbed wire fence between our properties. We had Arabrian horses which we did not around the wire fence and built a wooden fence between 2-3 feet inside the property line. The boundary stakes were(are) in the barbed wire fence line. Several years ago, the property sold, then was sold again, and again. Last year the owner hired someone to clear some of the land and he removed about 20% of the barbed wire fence. Most of it remains. That owner sold the property and the new owner is now building brick and stone fence post (pillars). We noticed today that they had put one that is now on our property. The property stake at the front of the property is not visible anymore (they may have poured concrete on it). What are rights and possible courses of action?
