Legal Question in Real Estate Law in Texas

I purchased a new $400 wireless phone and I went out and a waitress spilled water on it. I reported it to the manager and soon after I arrived home I noticed the phone didn't work. I called the corporate office and made a complaint. I sent the phone back to be repaired. Can I file a small claim without having the phone as evidence?

Until you have the repair bill, you won't know how much to sue for.

Yes, you can file the lawsuit before you have the phone back. Believe me, you'll get the phone back long before you go to trial.
