put up house for legal fees the lawyer had us sign a cash warranty deed for our house my husband inherited the lawyer is now about to be paid off will we get our house back in our name

Yes, you will. After you've paid off this lawyer, you should ask him politely about the appropriate real estate documents to transfer the house back to you (it will probably be a general warranty deed in which he is the Grantor and you are the Grantees).

Be sure you get a Warranty Deed and not a Quit Claim Deed. Texas does not recognize Quit Claim Deeds as providing good title. Also, you may want to have a title company or an attorney to look at your documents to make sure your title is back in place.
