my question is on gas and oil royalties

I didn't sign a gas lease with this gas company

can they take my gas anyway with out paying me?

Yes, maybe.

1. If they drill near your land, but not on it, the gas that is produced from their well may flow underground from under your tract to their well, depending on the geology of the producing formation.

2. If you don't own 100% of the minerals under your tract, others that own the remaining minerals could lease and allow drilling on the tract.
