Legal Question in Real Estate Law in Texas

Quit Claim of Life Estate in Mineral Holdings

The holder of a Life Estate for 50% of Oil & Gas Mineral Rights in a Deed of which I am the Owner/Remainderman, has agreed to sell their life estate to me.

The property is in Texas. I have not been able to find how this legal document should be written.

Should it be titled ''Quit Claim of Life Estate''? or perhaps some other wording?

Thanks so much.

Don't do this yourself. Mineral interests are important enough to where you should use an attorney and title company to ensure you have clear title to the property. This isn't an expensive procedure. Many title companies will not honor a quitclaim.

You need a mineral deed and I typically charge $100 to prepare such a document.

A Texas attorney who is familiar and experienced with these kinds of issues should draft the particular form of the deed required for this kind of proposed conveyance which one should then have reasonable assurance is in full compliance with the requirements of Texas state law (in my opinion).
