Raffles

Is it illegal to raffle a house in the state of Texas? For example, selling tickets and then drawing a winning ticket?

It is only legal if the raffler is a qualified nonprofit organization and follows the specific rules in the Texas Occupations Code.

If not, it is illegal gambling as defined in the Texas Penal Code. The raffler could be convicted of a Class A misdemeanor (up to 1 year in jail and $4000.00 fine) and all of the participants could be convicted of Class C misdemeanors (up to $500.00 fine).
