Real Estate Property 1.81 acres
Property we sold years ago and the buyer never paid the last payment and never came so we could transfer title to him. Taxes are in his name and we just found out they had not been paid since 2004. They have been sent to court. If a tax lien is put on them can they be put on us too since title is still in our name but tax in his name? We have not received any notices that taxes wer not being paid and assumed that they were. If we pay them and the court cost how to we get our contract to deed removed from records?

There are specific procedures to foreclose on a contract for deed which include notice and an opportunity to cure. You will need to contact an attorney to help you. Your foreclosure will not wipe out the tax lien and once you regain title, you will need to pay the taxes. If the taxing authorities foreclose before you do, your contract for deed will be wiped out.
