Our family is going through a civil suit, but there is real property involved. My husbands step father had a life estate in some property that he has turned back to My mother-in-laws estate, but before he left the property, he took many things. The property is @400+ acres, originally there were pens to work cattle along with a cattle squeeze shute. The step father not only took the squeeze shute, but he took all of the gates on the pens, the propane tank to the house, and the centeral heat and air unit. we want to press charges of theft or vandalism, but we don't know what to do. The local sherif won't take a statement stating that this is a civil case not criminal, what can be done?

The matter probably is both criminal and civil. However, a criminal fine or confinement does not recover the property for you or put money in your pocket. That is where the civil remedies come to play. You can file a lawsuit to recover the property that was taken as well as for damages for property which is not recoverable. Contact a near by attorney to file a suit for you.
