Legal Question in Real Estate Law in Texas
I recently was in the market to an apartment. I am currently living with my mom and I have an eviction on my credit. The evictionis really old and since then i have never attempted to get an apartment because of it. My mom and I were going to split up and I was supposed to try and find an apartment. I was told my several apartments that because my eviction was so old, they would work with me on a large deposit and no co-signer to lease to me. I found a complex that I applied for online. i was told they had a $99 move in and free for the remaining month of May. I informed before I completed my app that i had an eviction. The person I was working with said it could be ok. I was told my application was accepted. I then looked over their criteria and i saw they look at evictions for the past three years and my eviction was over 5 years ago. I then went to view the apartment and because of excitement I signed the lease. after signing the lease the agent gave me the "welcome home letter" which gives you your new address. She then stated that I needed a $250 deposit and she said my move date was 0524/10. I did not pay anything and I left. I felt weird because I was not expecting to pay a deposit and she didn't allow me to choose my move date. I talked it over with my mom and was advised i was getting screwed over some how. Two days later I informed the agent that I was not going to move in. Two weeks later I received an email stating tha I owe over $11.110 dollars due within 30 days because I cancelled my lease. What can i do about this? I'm thinking of filing bankruptcy if this appears on my credit. I tried to reason with the manager but she told me to either move in or it goes to collections. I have already moved into a new place with my mom and i attend Cosmetology school and I cannot afford an apartment on my own now.
