refinancing a privately held mortgage

I am a single women who relocated from CT (where I lived when I bought the townhome) to TX where the property is located.

The women who holds the mortgage has misrepresented the lateness of the mortgage payments to the new mortgage company I am trying to refinance with. She always waited until between the 14th and 21st of the month to cash the checks. So because she has lied to the mortgage company about my delinquincy, how can I prove my payment history when all the company wants are cancelled checks?

Sounds like the only evidence you have is the dates on the checks and your word. That doesn't mean that the new mortgage company won't believe you. Give it a try; we can file suit against your current mortgage holder if you want, but we'd have to discuss what you can achieve from that. For the future, set up automatic payments so your bank sends the check automatically. I use Chase but I'm sure many others have this service. NanceGroup.com
