Refusal to close on sale of property.

I have entered to into a contract to purchase a parcel of land. We are with in 4 days of closing the owner wants to back out. This is after he has found out there is $2800.00 judgement against him that he refuses to pay. We have paid for a survey, loan processing fee, and earnest money. We do have a signed sales contract. Do we have any legal recourse to encourage him to close? And if not can we get the seller to pay for our out of pocket expenses?

Depending on what the contract says, you may be able to sue to force him to close or for reimbursement of expenses, or both. Look at your contract.
