Release of Lien

A friend and I bought a house in

1996. In 2001 I bought her out,

and financed some of the pay-out

through the mortgage company.

They paid her, she received her

money, but the lien for what the

mortgage company paid is still

outstanding. Now I am trying to sell

the house and she won't sign the

release of lien. Do I have any

alternatives? Should the sale fall

though, would a lawsuit against her

have any change of succeeding?

Go to the title company that paid off the lien. They may be able to insure around it. The answer to question 2 is yes.
