Legal Question in Real Estate Law in Texas
Removing a roomate from lease
I live with a roomate. I am married, but my spouse is stationed in Korea. Myself, my roomate, and my spouse are all on the lease agreement. I wish to live alone, since it is almost time for my husband to come home. My roomate has a boyfriend who wants to move in. Can I take my husband's and my name off the lease and put my roomate's boyfriend on in our place? ( the boyfriend has agreed to it)

Re: Removing a roomate from lease
The lease is a contract you have with your landlord. If you wish to relieve your spouse and yourself of liability to the landlord you will have to get the agreement of the landlord. If your spouse is in the military, their may be some provision in the lease or under state statute relieving him of liability if he is restationed
