Legal Question in Real Estate Law in Texas
Renter stopped payment on check
I had a renter who was constantly late with the rent. He only paid 1/2 of the rent for April (and wrote that on the bottom of the check). I went and asked him for the rest of the rent on April 23rd and he refused so I asked him to move out. Yesterday I recieved the check back from my bank along with charges from my bank because he had stopped payment on the check he had written for the first part of the rent. He did move out last weekend but I wondered if I could do anything for the stop payment on the check?

Re: Renter stopped payment on check
You probably should not have tried to take the money if you told them to move out, which implies that you were not going to accept partial payment. If you were trying to get the money to cover amounts already owed to you and your lease covers that, then you could sue to collect those amounts or just more on to a new renter and new issues.
