renters rights

My family and & rented a house from a friend in May of 2001. We have always paid our rent until this past May 2003 I was injured and couldn't work and my husband still has not been paid by his employer. We did get behind on our rent and DID get it caught up in mid. Aug. He has told us we have to be moved out and gave us 2 weeks. I am still injured , not walking well and we have 3 children. Can he make us move in the 2 week period, or does he have to serve us papers?

No, by law he must give you 30 days written notice from the month-to-month rental period (usually by the 1st of the month to be moved out by the end of the month) or 30 days written notice one month from the end of the lease term. If you fail to move out, then the landlord could give you the 3 day eviction notice and, if you fail to move out, it usually takes an additional 20 days to go through the eviction hearing. Once evicted though the court process, an order will be issued and the constible can forcibly enter the premises and evict you.
