Legal Question in Real Estate Law in Texas

getting rid of a roommate

my mother has a couple renting a room in her house. She just found that since her insurance policy states that her property is a single family dwelling, she can not have any one living in the house that is not related to her, as that would be considered a multi-family situation. She gave the roommates notice to vacate on 2/13 to be out by 3/1. We fear the couple will not move out. I need to know if she will have to go through the eviction process since there was no lease or contract with the roommate couple.

Re: getting rid of a roommate

If they don't leave, she will need to file an eviction (called a forcible entry and detainer) in the local justice of the peace court. They have forms that explain the entire procedure.
