Legal Question in Real Estate Law in Texas

The roof is bad...

I bought a house almost seven months ago. It passed the inspection for a FHA loan. Recently, we found out that the roof is old and in very poor condition; we were told that roof was only 2 yrs old when we bought the house. According to several professional roofing companies, the roof should never have passed inspection. There was also a problem with ventilation of carbon monoxide. The vent from the hot water heater had been roofed over. The members of my household constantly breathed large amounts of carbon monoxide for several months before we found out about the leak. In the sellers disclosure it is stated that the roof is only two years old. The insurance company won't pay for a roof because it doesn't fit their criteria. I paid for the inspection that it should never have passed. I have no money for a roof. I have spoken with one attorney now, but he said he didn't know what to do. I'm not sure what to do now. Can you help me?

This is a prime example of why a professional inspector should have been hired prior to buying. You could have the items fixed and present the bills to the seller and agent for reimbursement if you felt misrepresentations were made. If they refuse to pay, you could take them to small claims court - you may win or you may lose.
