Legal Question in Real Estate Law in Texas

Roomate lied about signing lease-Do I have any rights?

Roomate and I agreed to move in together. We split the deposit in half. We split all the utility bills in half. After a month, she decided she would rather move back home, leaving me in a whole lot of financial mess because she lied about ever sighning the lease. Is a verbal contract legally binding in Texas?

Verbal contracts are legal, but difficult of proof. A "he-said, she-said" will not win in court. There must be more pebbles on your side of the scale than on hers.

Contracts affecting an interest in real estate must be in writing. Contracts to pay 1/2 of utility bills, etc., do not need to be in writing, but you need proof beyond just you saying yes and she saying no.

The hard lesson is that few folks these days feel bound by their word, so at least a Memorandum of Understanding is called for in most business relationships.
