Legal Question in Real Estate Law in Texas
Sellers disclosure
We are selling our house. We filled out a sellers disclosure when we listed the property. Since then, we have learned that there is a proposed 4 lane road to possibly be built about 50 ft from our property. We have asked city and state officials about this proposal and have received answers that this road, ''if it is ever funded and built'' is probably 10-15 years in the future. Do we have an obligation to re-do the sellers disclosure? Do we have to tell prospective buyers what we know? Thank you.

Re: Sellers disclosure
When in doubt, disclose. If the buyer is damaged by your failure to disclose and they can prove it up, you may be liable for damages.
