Legal Question in Real Estate Law in Texas

sellers disclosure statement reimbersment of inspection to buyer

I am selling my home, the disclosure statement asks about flooding. To the question of flooding on property and improvements I answered no,we have a room addition in uor garage but it is built on a raised floor. Water did enter our garage during Alicia butwas minimal and did not enter the addition or our home. That is why I answered no.We were out of the country at the time so when we returned we cut a couple of inches of sheetrock to make sure water was not

rapped. No problems were found.

Someone put a contract on the house and had an inspection done my husband was here and was asked about the sheetrock which had not been painted so it was obvious it had been repaired, so he told him the reason why. I

also found out from their realtor that they knew someone who knew our neighbor and that this neighbor told them our house flooded (not true)and that thier was gang activity on our street also not true. This is the real reason I feel they changed their minds. Now they are threatning small claims court and say they can seek 3x's thedamages, which are 175.00 inspetion,49.00 termite, and 50.00 option feE. Also they are saying that the Texas Tort Law states that I have committed fraud. What is the Texas Tort Law?

Sounds like you may be needing an attorney soon. From what you have said it sounds to me like they are threatning a lawsuit under the Texas Deceptive Trade Practices Act. As far as Texas Tort Law what they are referring to is bringing an action based on fraud.
