Legal Question in Real Estate Law in Texas

Selling my grandparents' home

My maternal grandparents are both deceased and my mother had been renting out their home. She is deceased with two brothers. One can not be located. The other one wants to sell and I want to sell. Currently, I collect the rent. How can I represent my Mother along with one of her brothers to get the house sold since my grandparents didn't have a will and neither did my mother?

Re: Selling my grandparents' home

This is all going to depend on when everyone died, as the intestacy laws in Texas have changed within the last decade. There is also a problem with the unlocated brother/uncle, as he may own a share of the home. Basically, I can clear title from the deceased grandparents and the deceased mother by drafting appropriate affidavits. This would likely place title collectively in you and your uncle (assuming there are no other family members). This can all be handled fairly inexpensively. If the brother can still not be found, things get a bit more expensive, as his interest would likely require court intervention, such as a motion to partition property (i.e. a court ordered sale of the property.) I'd have to discuss the matter in more detail, however.
