selling a home.

I sold my home to a couple 2 years ago.I got a letter from an attorney today saying that there is termite infestation and the house needs to be destroyed. They say that I did not disclose that there were termites. I did not know there were termites or any thing else in the wood. The buyers had Terminix come out to check the house before they bought it. How can they sue me if I had no idea there was damage and they had someone check it out with the buyer there at the time it was checked out?

If you were not aware of any termite infestation and, more over, they had the house inspected for termites, then they probably don't have a viable case against you regarding the house. Of course, I base that on the facts you have provided.

Presumably they are claiming a violation of the Deceptive Trade Practices Act. If so, it is possible that the statute of limitations has run out if this transaction happened over 2 years ago. That may provide you an additional defense against any lawsuit.
